One of the steps the government took as part of its fight against FETÖ was the decision to reject requests for postponement of bankruptcy for the duration of the state of emergency (OHAL). Attorney Assoc. Prof. Dr. Mehmet Köksal, a faculty member at Near East University and a guest on the “Burası Türkiye” programme, stated that the decision on postponement of bankruptcy should be made by the judiciary and that there was no need for such a ban.

Köksal stated that, with this decision — through a decree having the force of law concerning the commercial code — they had removed the right to postponement of bankruptcy of a company that is in difficulty but could in fact be saved, whereas the Council of Ministers may issue decrees having the force of law only on matters that the state of emergency makes necessary.
