Why does the certificate call for “advisory”?
The investment incentive certificate is not a form but a financial-architecture decision: the class of the investment (regional, priority, strategic), the composition of the support elements and timing determine the project’s real return. The costliest mistake is applying after the investment has begun — expenditures made before the application fall outside the scope for most items. The second costliest mistake is failing to set the committed employment and amounts realistically; at the completion-visa stage, the shortfall turns into the risk of the incentives being clawed back.

The foreign-investor dimension
Under the equality principle of Law No. 4875 (Turkish Foreign Direct Investment Law), companies with foreign capital benefit from every window on the same terms as domestic investors. Intra-group machinery transfers, used-machinery rules and the interaction with double-taxation treaties must be planned separately in cross-border structures. The legislation, and what the support actually consists of
The system sits under the Decree on State Aid in Investments (2012/3305) together with the decisions and communiqués that update it. The secondary legislation changes often, and reclassifications and rate changes create timing risk of their own. The support attached to the certificate is calculated component by component: the VAT exemption, the customs duty exemption, the reduced corporate tax rate, support for the employer’s share of social security premiums, interest or profit-share support depending on the region and the class, and the allocation of land for the investment. Call-based programmes — the strategic and technology-focused initiative calls — open separate windows again. Which component actually turns into cash is a function of the province, the class and the company’s own tax position: with no taxable base to absorb the reduction, the incentive stays on paper.

Depending on the realisation rate, the support may be reclaimed in part or in full, with interest. We set up periodic commitment monitoring for early warning and, where necessary, file a revision application in due time.
Transfer of the certificate is possible but subject to approval and conditions; the commitments are taken over as well. Before the transaction, the incentive file must be reviewed as a separate due diligence item.
